Abstract
Background. Being a universal trend of modern transformations in society, digitalization also affects the organization and activity of the judiciary. The main idea of reform is built around the concept of “Digital Justice”. Simultaneously, it is proposed to create “Electronic Filing”. The planned changes affect basic legal institutions, which actualizes the search for the boundaries of introducing digital technologies in the process of exercising power. The main goal is to determine the legal regime of digital justice and to identify the key problems that arise due to the implementation of this concept. The objectives of the study are to examine the concept of digital justice, related categories, and to highlight the areas of reform. Materials and methods. The empirical basis of the study consists of the Russian and foreign doctrinal sources and analytical reports. Particular attention is paid to the practices of the People’s Republic of China in introducing information and communication technologies into the judiciary (the concept of “Smart Court”). Results. The article indicates that the concept of “Digital Justice” is a large-scale project aimed at significant transformations in the organization and activity of the judiciary, as well as other bodies delivering justice, due to the introduction of digital technologies. A comparative description with the concept of “Electronic Filing” is carried out. Foreign practices in introducing digital technologies into the activity of the judiciary are presented (the Republic of Kazakhstan and the People’s Republic of China are taken as examples). The possibility of introducing a digital judge into practical activity is analyzed. Conclusions. The content of the concept of “Digital Justice” is identified, covering the entire digital segment (control technologies, software solutions, algorithms, databases, as well as hardware that ensures the functioning of information and communication technologies) within the judiciary. This is the digital ecosystem of Russian courts. The article shows that the most heated public discussions in the modern world are caused by the possibility of using artificial intelligence in the public sphere.
